What is ORSO?
ORSO stands for "Occupational Retirement Schemes Ordinance".
ORSO was enacted in December 1992 and came into operation in October 1993.
The objective of ORSO is to establish a registration system for voluntarily established occupational retirement schemes, to ensure that such schemes are properly regulated, and to provide greater certainty that retirement scheme benefits promised to employees will be paid when they fall due.

A Defined Contribution Scheme is a scheme where the contribution rates are defined and the amount of benefits accrued is based on the accumulated contributions with investment income. Members usually do not get the full benefits funded by their employers unless they meet certain criteria, such as age, years of service or a combination of the two.

A Defined Benefit Scheme is a scheme where the employer's contribution rates are not defined and the amount of benefits a member can get is based on a formula with reference to his age, years of service, final average salary etc.
What is MPF Exempted ORSO Registered Scheme?
What is MPF Exempted ORSO Registered Scheme?
An MPF exempted ORSO registered scheme means a scheme in respect of which an exemption certificate has been issued.
A condition for MPF exemption is that the employer must give all existing members and new eligible employees (if applicable) an one-off option to choose between the existing ORSO scheme and an MPF scheme.
Existing Members
An Existing Member is an employee who has become a member of the ORSO scheme on or before 1 December 2000.
New Eligible Employees
A new eligible employee is an employee who is eligible to join the ORSO scheme after 1 December 2000.

What is Minimum MPF Benefits?
A new member's benefits accrued under an MPF Exempted ORSO Registered Scheme will be subject to the preservation, portability and withdrawal requirements up to an amount equivalent to the "Minimum MPF Benefits".
"Minimum MPF Benefits" in relation to a member of a relevant scheme, means the lesser of -
1. The member's benefits accrued and held under the scheme during the years of post-MPF service; and
2. 1.2 x final average monthly relevant income x years of post-MPF service
Years of Post-MPF Service
Years of post-MPF service in relation to a member of a relevant scheme, means the member's continuous years of service (including complete months of a year) from the date he/she joined the scheme or 1 December 2000, or the date on which the trustee of the scheme received his/her claim for which benefits were last paid on the ground of terminal illness, whichever is the latest, to the earliest of the date of termination of his/her employment or in the case of the winding up of the scheme, the date on which he/she ceases to be a member or the date of the coming into effect of the withdrawal of exemption certificate or the date on which the trustee of the scheme receives his/her latest claim on the ground of terminal illness for which benefits have not been paid.
Final Average Monthly Relevant Income
Final average monthly relevant income means the member's relevant income per month averaged over:
if the member has been a member of the scheme for not less than 12 months after 1 December 2000, i.e. the commencement date of the MPF System, the period of 12 complete months (excluding any unpaid leave or maternity leave taken by the member pursuant to any enactment or contract) immediately preceding the earliest of the date of termination of his/her employment or in the case of the winding up of the scheme, the date on which he/she ceases to be a member or the date of the coming into effect of the withdrawal of the exemption certificate or the date on which the trustee of the scheme receives his/her latest claim on the ground of terminal illness for which benefits have not been paid; or
in any other case, the period (excluding any unpaid leave or maternity leave taken by the member pursuant to any enactment or contract) since the date the member joined the scheme or 1 December 2000, whichever is the later, to the earliest of the date of the termination of his/her employment or in the case of the winding up of the scheme, the date on which he/she ceases to be a member or the date of the coming into effect of the withdrawal of the exemption certificate or the date on which the trustee of the scheme receives his/her latest claim on the ground of terminal illness for which benefits have not been paid.
Relevant income will be capped by the maximum level of HK$30,000 per month first before calculating the average.
Relevant Income
In the case of a relevant employee, any wages, salary, leave pay, fee, commission, bonus, gratuity, perquisite or allowance, expressed in monetary terms, paid or payable by an employer (directly or indirectly) to that relevant employee in consideration of his employment under that contract, but does not include severance payments or long service payments under the Employment Ordinance (Cap. 57);
In the case of self-employed person, the calculation of relevant income is basically linked to his/her assessable profits that are calculated in accordance with the Inland Revenue Ordinance.
